Sinkhole Insurance & 5 Year Date of Loss

Sinkhole Insurance is available in only a few states. Luckily, Florida is one of the only states that offers and provides sinkhole insurance coverage for homeowners. Every year it is important to check your Florida sinkhole insurance policy to make sure you maintain your sinkhole insurance and have adequate coverage. Many sinkhole insurance companies are non-renewing sinkhole insurance policies to escape potential sinkhole insurance and claim liability. In some counties such as Pasco and Hernando just north of Tampa, you have to opt in to have sinkhole insurance coverage.

Florida Statutes
Our Florida Statutes Sinkhole Laws page is a great resource for Florida homeowners to understand the rights about being "non-renewed" or increased policy premiums for filing a claim. Section 627 has many laws that protect the insured in a sinkhole claim. Many homeowners are wrongfully denied in sinkhole claims because they are uneducated about what they can do. The insurance company typically does not perform proper testing under the statute assuming the homeowner does not know the processes and procedures.

Date of Loss - Within 5 Years?
In addition there is something called a 5 year date of loss to protect the insured in a sinkhole insurance claim. If you have been denied for any reason, it is possible for an adjusting company such as SinkTeam or a lawyer to review the denied documents and determine next steps and options for you to recover money in your policy for your house damage.

If you do not currently have sinkhole insurance, you may still have options under Florida's 5 year date of loss. If you had sinkhole insurance coverage in the last 5 years and the sinkhole damage occurred within the policy dates when you had insurance, then you could have the possibility of filing a claim on a prior policy. This is tricky because it's termed "back-dating." You need to be clear when everything happened and tell the truth.

This probably sounds complicated! For more information, call the SinkTeam experts at 813-435-1616 for more information about your options!
